Using Our Services

Scope

This Acceptable Use Policy (this “Policy”) governs the usage of our products and services (the “Services”). This Policy is incorporated by reference into each agreement we enter into with a client (the “Client”) for the use of such Services.

We may modify this Policy at any time without notice by posting updated versions on the Virtual IT Managed Services website.

Purpose

The purpose of this Policy is to enhance the quality of the Services and to protect Virtual IT Managed Services Clients, as well as the Internet community as a whole, from illegal, irresponsible, or disruptive Internet activities.

This Policy applies to each Client and its employees, agents, contractors, or other users of such Client who obtain Services from Virtual IT Managed Services (each such person being a “User”).

Each User should use common sense and good judgment in connection with the Services.

Prohibited Uses

Users may not engage in the following activities:

Illegal or Unauthorized Activities

  • Utilise the Services to copy material from third parties (including text, graphics, music, videos, or other copyrightable material) without proper authorization.
  • Utilise the Services to misappropriate or infringe patents, copyrights, trademarks, or other intellectual property rights of any third party.
  • Utilise the Services to traffic in illegal drugs, illegal gambling, obscene materials, or other products or services prohibited under applicable law.
  • Utilise the Services to export encryption software outside of Australia in violation of applicable export control laws.
  • Utilise the Services in any manner that violates applicable law.

Tortious or Actionable Activities

  • Publish or disseminate information that constitutes slander, libel, or defamation.
  • Publish or disseminate information that publicises the personal information or likeness of a person without their consent.
  • Publish or disseminate information that otherwise violates the privacy rights of any person.
  • Threaten persons with bodily harm, make harassing or abusive statements, or solicit acts or services that are illegal under applicable law.

Disruptive or Abusive Activities

  • Cause denial-of-service attacks against Hosted Network or other Internet users.
  • Subvert, or assist others in subverting, the security or integrity of any Hosted Network systems, facilities, or equipment.
  • Gain unauthorized access to the computer networks of servers or any other person.
  • Provide passwords or access codes to unauthorized persons.
  • Forge signatures, impersonate another person, or engage in spoofing to deceive others.
  • Distribute or post viruses, worms, Trojan horses, or malicious code intended to disrupt services or damage data/equipment.
  • Conduct port scans or invasive procedures against any server (except where the User is an authorized system administrator).
  • Distribute, advertise, or promote spam-related software or services.
  • Collect or distribute email address lists for spam purposes.
  • Send or distribute sexually explicit, hateful, vulgar, racially, ethnically, or otherwise objectionable material, as determined by Hosted Network in its sole discretion.
  • Interrupt or interfere with the Internet usage of others.

Violations

Disclaimer

Hosted Network expressly disclaims any obligation to monitor its Clients and Users for violations of this Policy. Hosted Network has no liability or responsibility for the actions of any Client or User, or for any content posted by a User.

Reporting Non-Copyright Violations

Users are encouraged to report violations of this Policy by emailing helpdesk@hostednetwork.com.au. Reports should include the offending domain (e.g., xyz.com) and the type of abuse (e.g., spam, illegal acts, harassment) in the subject line of the email.

Remedies

If Hosted Network becomes aware of a violation of this Policy, it may, at its sole discretion and based on severity, take the following actions (without obligation to do so):

  • Issue a warning to the Client.
  • Suspend the Client from the Services.
  • Terminate the Client’s Services.
  • Impose fees or charges in accordance with the applicable service agreement.
  • Remove offending content.
  • Take any other action permitted by law, contract, or this Policy.

Reservation of Rights

Virtual IT Managed Services reserves the right to cooperate with appropriate legal authorities in investigations of alleged illegal activities involving its Services.

Virtual IT Managed Services reserves all rights to respond to violations of this Policy in accordance with applicable law and contractual obligations.

We may utilise technical means to monitor communications into and out of our network facilities to:

  • Prevent the introduction of viruses or hostile code.
  • Prevent intrusions.
  • Enforce this Policy.

Each Client agrees that Virtual IT Managed Services is authorized to monitor its communications through our network for such purposes.
